Where Required

1. A Type I hood shall be installed at or above all commercial cooking appliances and domestic cooking appliances used for commercial purposes that produce grease vapors, including but not limited to cooking equipment used in fixed, mobile, or temporary concessions, such as trucks, buses, trailers, pavilions, or any form of roofed enclosure, as required by the Fire Marshal.

2. A Type I hood shall not be required for an electric cooking appliance where an approved testing agency provides documentation that the appliance effluent contains 5 mg/m3 or less of grease when tested at an exhaust flow rate of 500 cfm (0.236 m3/s) in accordance with UL 710B; additionally, fuel gas and power provided for such cooking appliances shall be interlocked with the extinguishing system, as required by Section 904.12.2; fuel gas containers and piping/hose shall be properly maintained in good working order and in accordance with all applicable regulations.

(Reason: To require fire protection and prevention for mobile food trucks and other mobile commercial cooking operations for the protection of occupants and first responders, including the fuel gas utilized for the cooking operation.)

Exceptions: 1. Tents, as provided for in Chapter 31.

Tents and membrane structures

1. Tents and membrane structures shall be in compliance with IFC Chapter 31. Tents and membrane structures (including bounce houses) over 400 square feet in size shall require a permit from the Fire Marshal’s Office (FMO) and have a fire inspection completed prior to occupancy. A label with the size and type of material shall be attached to all tents and membrane structures. All tents and membrane structures shall be anchored properly and per the manufacturers recommendations.

Exception: Tents open on all sides and under 700 square feet in size.

2. Tents over 400 square feet in size, and not meeting the exception above, shall comply with the following: 

     a. Submit a copy of the flame retardant treatment certification (NFPA 701) to the FMO.

     b. Illuminated exit signs.

     c. Egress illumination lights.

     d. Minimum of one 2A:10BC fire extinguisher, with current inspection tag. 

     e. No Smoking signs. 

     f. No open flames or cooking without FMO approval and NFPA 701 compliance. 

     g. Ten-foot clearance from building and other tents. 

     h. All electrical wiring and equipment shall comply with NFPA 70 Electrical Code. 

     i. Un-vented, fuel-fired heaters are prohibited for use inside enclosed tents and membrane structures. Other heaters require FMO approval.

 3. Tents and membrane structures shall not be located in fire lanes or emergency access routes.
